I understand and agree that in the performance of my duties, as a representative of my company, organization, or as a private individual, I must hold any and all information including, but not limited to medical, financial, and/or other sensitive information in confidence. I understand that the unauthorized release of information may subject my company, organization, Trinity Health, as well as me, to legal action.
All direct knowledge or information about patients/residents, medical center, or any other information that is generated or viewed during duties performed at any entity which is stored via paper, on computer, or as a matter of general knowledge is considered privileged and confidential and will be protected.
Computer processed patient/resident/provider/employee/private information shall be safeguarded with the same diligence as medical records and will be protected from unauthorized disclosure, modification, deletion, and usage. I understand that I will be held accountable for all transactions performed or viewed on the computer (generated by me or not) using my logins and passwords.
I agree that I will not release unauthorized information to any source in any matter either during the period of system access or any time period after access is no longer granted.
I understand that any violation of misuse of confidential medical, financial, or other related information will result in the termination of system access. Under certain circumstances, individuals may be subject to legal action for violation of the policy.
Confidentiality Statement Guidelines
Organizational information that may include, but is not limited to, financial, patient identifiable, employee identifiable, individual identifiable, intellectual property, financially non-public, contractual, of a competitive nature, and from any source or in any form (i.e. paper, magnetic or optical media, conversations, film, etc.) may be considered confidential. Information's confidentiality and integrity are to be preserved and its availability maintained. The value and sensitivity of information is protected by law and by the strict policies of Trinity Health. The intent of these laws and policies is to assure that confidential information will remain confidential through its use, only as a necessity to accomplish the organization's mission.
It is each individual's responsibility as a condition of receiving access to confidential information to be aware of and comply with confidentiality issues. The following are examples and are not all inclusive:
- The log-on code is equivalent to your LEGAL SIGNATURE. This code must not be disclosed to others, and no one should be allowed to access systems using your log-on code.
- You are responsible and accountable for all entries made and all retrievals accessed under your log-on code, even if such action was made by you or by another individual due to your intentional or negligent act or omission. Any data available to you must be treated as confidential information whether it is on computer or any other form.
- Attempting to learn or use another's log-on code is against policy.
- Attempting to access any online computer system using a log-on code other than your own is prohibited.
- Attempting to access or request any information that you have no responsibilities for is against policy.
- If you have reason to believe that the confidentiality of your user log-on code/password has been compromised, you will immediately change your password and notify the Trinity IT Department at (701) 858-6464.
- Disclosure of any confidential information, unless required to do so in the official capacity of your duties or contract, is against policy. You have no right or ownership interest in any confidential information.
- Leaving a secured computer application unattended while signed on is a possible opportunity for someone else to document or access information under your name.
- Your use of systems may be periodically monitored to ensure compliance with this agreement.
- You agree not to use the information in any way detrimental to the organization and will keep all information confidential.
- Limiting distribution of confidential information to only parties with a legitimate need in the performance of the organization's mission is your responsibility.
- You agree that the disclosure of confidential information is prohibited indefinitely, even after termination of the business relationship, unless specifically waived in writing by the authorized party.
